HIV Status Alleged as Reason for Applicant’s Rejection by Service Provider
Abstract
Plaintiff adult diagnosed with human immunodeficiency virus (HIV)
sued defendant, a nonprofit corporation providing housing and
vocational services to individuals with developmental disabilities,
for federal law violations. Plaintiff applied to defendant’s
vocational and residential programs, and defendant tentatively
accepted him. After a social service agency assisting plaintiff in
securing services included, in information that it gave to
defendant, a reference to plaintiff’s HIV status, defendant
denied plaintiff’s admission due to his “communicable
disease.” Plaintiff maintains that he is qualified for
placement in defendant’s residential program and for
receiving its services because he has a developmental disability
and that he is substantially limited in one or more major life
activities, including reproduction. In district court, plaintiff
alleges that his rejection by defendant was based on unfounded
fears and stereotypes regarding persons with HIV; his rejection
violates Section 504 of the Rehabilitation Act of 1973, Section 804
of the Fair Housing Amendments Act, and Title III of the Americans
with Disabilities Act. Plaintiff seeks injunctive relief,
compensatory and punitive damages, and attorney fees.
