Description
Mexican Citizen Claims that Colorado Jail Violated His Constitutional Rights by Denying Him Sanitary Housing and Medical Treatment and Thus Causing Leg Amputation
Abstract
Plaintiff Mexican citizen, who was detained in defendant county
jail, brought suit under Sections 1983 and 1988 and charged that
defendant county and county jail officials violated his Eighth
Amendment right and due process and equal protection rights under
the Fourteenth Amendment when they denied him sanitary housing and
medical treatment which resulted in the amputation of his leg.
Plaintiff was a passenger in a truck when he was detained by
Immigration and Customs Enforcement for an immigration violation
and taken to county jail. He was never charged with a crime.
Plaintiff alleges that the jail was overcrowded and dirty, causing
plaintiff to contract multiple infections. He contends that jail
administrative and medical staff failed to provide proper medical
treatment and caused him to go into a coma and have one of his legs
amputated. Plaintiff alleges that defendants violated his basic
Section 1983 rights to sanitary housing and medical treatment by
failing to enact and enforce policies and procedures requiring
sanitary and clean cells and adequate and competent medical staff.
Plaintiff seeks damages, costs, fees, and punitive damages for
defendants’ reckless disregard of plaintiff’s
constitutional rights.
