Tenant Claims Threat to Turn Off Water Service Violates Due Process

Abstract

In a petition filed with the city council to challenge the lack of due process procedures for terminating water services, petitioner alleges that she paid the previous month’s water bill after receiving a "final notice" water bill the following month. The "final notice" threatened to terminate her water service. She then paid the next month’s bill. Petitioner claims that the city never gave her written notice of its water termination procedures and policies, in violation of her Texas and U.S. constitutional due process rights. Petitioner requests a city council investigation of the policies and procedures used to terminate water service, a public hearing to discuss the findings, and an order for the Water Department to adopt procedures and policies to protect indigent residents’ due process rights.
