General Assistance Claimant with Mental Disability Is Entitled to Retroactive Benefits

Abstract

The hearing officer has held that claimant is entitled to retroactive general assistance (GA) benefits. Claimant’s application for GA indicated that she had injured her back and was unable to work. Her application was denied. Upon her reapplication, claimant was granted a three-month disability period. On appeal of the initial denial, the hearing officer found that claimant had mental disabilities that rendered her unable to present her case on her own. The hearing officer noted that claimant had been in treatment for depression for one year and that upon receiving her denial letter she was readmitted to the hospital for “suicidal threats.” Finding it clear that, with assistance from her intake worker, claimant’s initial application for GA would have been granted, the hearing officer awarded claimant retroactive benefits.
