Class Action Challenges Admission Procedures for Section 8 New Construction
Abstract
In this class action filed in Indiana, plaintiffs allege that the
admission procedures for an Indiana Section 8 new construction
housing project violate their due process rights. In their
complaint, brought under the United States Housing Act of 1937,42
U.S.C. §§ 1437 et seq., plaintiffs complain that
defendants have failed to (1) maintain and apply uniform
ascertainable standards for the selection of tenants for Section 8
new construction housing, (2) provide adequate and specific written
reasons for the denial of admission to Section 8 new construction
housing, and (3) provide an opportunity for an informal hearing
concerning the denial of admission. Plaintiffs are seeking
injunctive relief.
