Using Bankruptcy to Thwart PHA Evictions

Until recently, legal services attorneys have successfully used bankruptcy as a last-resort means of halting eviction of PHA tenants for nonpayment of rent; in In re Howard, however, a bankruptcy judge in Mobile lifted the automatic stay and allowed a PHA to proceed with an unlawful detainer action in state court.
