Discharging Student Loans Based on False Certification of Ability to Benefit

Trade school students whose ability to benefit from the courses of study in which they enrolled was falsely certified by the school may be eligible to discharge their liability on student loans. This article offers a history of the ability-to-benefit rules and an outline of fraudulent trade school admission practices.
